FamilySafe policy
Terms of Service
Effective 2026-09-27 · Version 3
By creating an account, checking an acceptance box, submitting an order or registration, accepting a proposal or quote, enrolling in a service, or otherwise using a service after being presented with these Terms, you agree to be bound by them.
If you do not agree to these Terms, do not purchase, register for, or use the applicable service.
1. Eligibility and Authority
You must be at least 18 years old to enter into these Terms on your own behalf.
A person younger than 18 may participate in an offering when permitted by FamilySafe, but a parent, legal guardian, or other person legally authorized to act for the minor may be required to register, consent, accept applicable terms, or execute additional documents.
If you purchase, register, or accept an agreement on behalf of a business, school, employer, association, facility, or other organization, you represent that you have authority to bind that organization to the applicable agreement.
2. FamilySafe Services
FamilySafe provides educational, training, preparedness, examination-preparation, skills-practice, coaching, workforce-readiness, workplace-safety, business, and related services as specifically described for each offering.
The scope, delivery method, duration, price, prerequisites, access period, scheduling requirements, completion requirements, and other material terms of an offering are those disclosed for that offering at the time of purchase, registration, quotation, or agreement.
FamilySafe may provide services online, virtually, in person, through self-paced instruction, through instructor-led instruction, or through a combination of delivery methods.
3. Educational and Credentialing Limitations
FamilySafe will not represent an offering as a government-approved training program, professional license, regulated credential, third-party certification, or authorized third-party course unless that representation is expressly stated for the particular offering and FamilySafe is authorized to make it.
An examination-preparation course is preparation for an examination. It does not itself establish examination eligibility or constitute a license, certification, or government-approved training program unless expressly stated otherwise.
A FamilySafe certificate generally documents completion of the identified FamilySafe offering. It does not constitute professional licensure, government certification, employment authorization, or a third-party credential unless the certificate and offering expressly state otherwise.
Third-party branded credentials are governed by the rules and requirements of the applicable third-party organization.
4. No Guarantee of Outcome
FamilySafe does not guarantee:
examination eligibility;
examination passage;
certification or licensure;
employment;
job placement;
promotion;
wages or earnings;
acceptance by an employer, school, licensing body, or credentialing organization;
regulatory compliance;
business results; or
any particular educational or professional outcome.
Learners and organizations remain responsible for determining the requirements applicable to their individual circumstances.
FamilySafe may provide information concerning current requirements as an educational resource, but requirements established by government agencies, testing organizations, credentialing bodies, employers, or other third parties may change without FamilySafe's control.
5. Accounts and Credentials
You are responsible for providing accurate registration information and maintaining the confidentiality of your account credentials.
You are responsible for activity conducted through your account except to the extent caused by unauthorized access for which you are not responsible.
Unless FamilySafe expressly authorizes otherwise, an individual learner account and course enrollment may be used only by the registered learner.
You may not share, sell, transfer, lend, or permit another person to use your account or enrollment.
FamilySafe may require identity verification when reasonably necessary to protect account security, assessment integrity, payment records, completion records, or certificates.
6. Course Access
Purchase of an online offering provides a limited right to access that offering for the access period stated at purchase.
Purchase does not transfer ownership of course materials.
Course access may expire at the end of the stated access period even if the learner has not completed the offering.
FamilySafe may provide extensions, reinstatements, or additional access in its discretion or under an offering-specific policy. Unless expressly promised at purchase, an extension is not guaranteed.
Previously earned completion records may remain in FamilySafe's records after active course access expires.
7. Completion and Certificates
A learner must satisfy the completion requirements identified for the applicable offering before FamilySafe is required to issue a completion certificate or record.
Requirements may include lesson completion, attendance, assessments, skills demonstrations, assignments, minimum scores, instructor verification, or other stated requirements.
FamilySafe may withhold, revoke, correct, or invalidate a completion record when reasonably supported by evidence of fraud, impersonation, falsification, assessment misconduct, system manipulation, administrative error, or failure to satisfy required completion criteria.
FamilySafe may maintain certificate-verification records after course access ends.
8. Scheduling, Attendance, and Participation
Live, virtual, in-person, coaching, employer, and group services may be subject to scheduling, attendance, capacity, prerequisite, equipment, safety, cancellation, and rescheduling requirements.
Participants are responsible for arriving or connecting on time and complying with reasonable instructor and safety directions.
Late arrival, absence, early departure, failure to participate, failure to bring required materials, or failure to satisfy a prerequisite may prevent completion or require rescheduling.
Terms disclosed for the particular offering become part of the agreement for that service.
9. Physical Skills Practice and Safety
Certain FamilySafe offerings may involve physical movement, kneeling, lifting, positioning, compression practice, use of training equipment, simulated emergency response, or other physical activity.
Participants are responsible for notifying FamilySafe of limitations or accommodation needs that may affect safe participation.
A participant should not perform an activity that the participant reasonably believes cannot be performed safely.
FamilySafe may stop or modify a participant's activity when reasonably necessary for safety.
Some activities may require a separate participation acknowledgement, consent, or release. These Terms do not replace a separately required waiver or consent document.
10. Emergencies and Medical Information
FamilySafe training is educational and is not emergency medical care, diagnosis, individualized medical treatment, or a substitute for professional medical services.
In an actual emergency, call 911 or the appropriate emergency service and follow instructions from qualified emergency personnel.
Training examples and scenarios are intended for educational purposes. Actual emergencies vary and may require actions based on circumstances, current professional standards, applicable laws, emergency-dispatch instructions, or directions from qualified responders.
11. Reasonable Accommodations
FamilySafe will consider reasonable requests concerning accessibility or participation accommodations.
Participants should provide reasonable advance notice when an accommodation may require changes to equipment, scheduling, instructional delivery, or physical arrangements.
FamilySafe is not required to waive an essential safety, competency, credentialing, or completion requirement when applicable law does not require such a modification.
12. Third-Party Standards, Organizations, and Materials
FamilySafe offerings may reference government guidance, professional standards, testing organizations, credentialing bodies, publishers, manufacturers, or other third-party sources.
Third-party names, trademarks, standards, publications, systems, and materials remain the property of their respective owners.
Reference to a third party does not by itself imply sponsorship, endorsement, affiliation, authorization, or certification.
FamilySafe will not represent itself or an offering as authorized by a third-party credentialing organization unless the applicable authorization is active and the offering is expressly identified as such.
Third-party requirements may be changed by the applicable organization without notice to or control by FamilySafe.
13. Employer and Group Services
A business, employer, school, association, facility, or other organization purchasing FamilySafe services is responsible for providing accurate participant information and communicating any material site-specific requirements relevant to the service.
When services are delivered at a customer-controlled location, the customer is responsible for providing a reasonably safe and suitable location unless otherwise agreed in writing.
Unless FamilySafe expressly agrees otherwise in writing, FamilySafe training does not replace an employer's responsibility to:
evaluate workplace-specific hazards;
maintain required safety programs;
maintain exposure-control or emergency plans;
provide required equipment or protective equipment;
maintain legally required records;
conduct required site-specific training;
supervise employees;
implement engineering or administrative controls; or
satisfy other obligations imposed by applicable workplace law or regulation.
Completion of a general FamilySafe workplace course does not by itself establish an employer's compliance with OSHA or another regulatory requirement.
14. Prices and Payment
The price charged for a service is the price presented and accepted for that transaction, subject to applicable taxes, fees, discounts, credits, or written adjustments.
Payment may be required in full or according to a deposit or payment schedule stated for the offering, quote, proposal, or agreement.
FamilySafe may decline to begin or continue services when an amount that is presently due remains unpaid.
Third-party payment processors may process payments on FamilySafe's behalf.
15. Refunds, Cancellations, Rescheduling, and Credits
Refund eligibility, cancellation deadlines, rescheduling rights, deposits, credits, no-show treatment, and related payment rules are governed by:
any specific written terms accepted for the particular offering;
any accepted quote, proposal, or separate agreement applicable to that transaction; and
the FamilySafe Refund & Cancellation Policy applicable to the transaction.
FamilySafe will not retroactively replace the material refund or cancellation terms governing a completed transaction merely by later changing its general policy.
16. Payment Disputes and Chargebacks
If you believe a FamilySafe charge is incorrect, you should contact FamilySafe promptly so the issue can be investigated.
Nothing in these Terms limits a consumer's lawful rights to dispute an unauthorized, fraudulent, or otherwise legally disputable transaction.
FamilySafe may provide enrollment records, account records, acceptance records, transaction records, attendance records, usage records, communications, and other relevant documentation to a payment processor or financial institution when responding to a payment dispute or chargeback.
Fraudulent or abusive payment disputes may result in suspension of access and collection of amounts lawfully due.
17. Intellectual Property
FamilySafe-created curriculum, text, graphics, videos, demonstrations, assessments, questions, handouts, templates, forms, lesson structures, instructor materials, downloadable resources, software, branding, and other original materials are owned by or licensed to FamilySafe and are protected by applicable intellectual-property law.
Purchase or enrollment grants only a limited, nonexclusive, nontransferable right to use the applicable materials for the purchaser's or registered learner's authorized participation in the purchased service.
Except with prior written authorization, you may not:
reproduce or redistribute FamilySafe course content;
publish restricted materials;
resell or sublicense access;
share login credentials;
record restricted instruction;
distribute assessments or answer keys;
create unauthorized derivative training materials;
remove copyright or proprietary notices;
systematically download or scrape content;
use FamilySafe materials to build a competing course or commercial training product; or
use restricted FamilySafe content for automated data extraction, dataset creation, or artificial-intelligence model training.
Ordinary personal notes taken by a learner for the learner's own educational use are permitted.
18. Acceptable Use and Academic Integrity
You may not:
attempt unauthorized access to FamilySafe systems;
interfere with website or platform operation;
circumvent access controls;
introduce malicious code;
impersonate another person;
falsify attendance or completion;
have another person complete required work on your behalf;
obtain or distribute restricted assessment content;
manipulate records or certificate information;
harass instructors, participants, customers, or staff;
use FamilySafe services for unlawful activity; or
otherwise materially misuse a FamilySafe service.
19. Suspension or Termination
FamilySafe may suspend or terminate access when reasonably necessary because of:
nonpayment;
fraud;
account compromise;
material violation of these Terms;
academic or assessment misconduct;
threats or serious disruptive conduct;
safety concerns;
unauthorized distribution of FamilySafe materials; or
unlawful use of the service.
When practicable under the circumstances, FamilySafe may provide an opportunity to correct a curable violation.
A person whose access is terminated for material misconduct is not automatically entitled to a refund. Refund rights remain subject to applicable law and the terms governing the transaction.
20. Service and Curriculum Changes
FamilySafe may update course content, references, assessments, technology, instructors, schedules, locations, delivery methods, or platform features when reasonably necessary to maintain accuracy, safety, availability, quality, or current educational content.
FamilySafe may correct typographical, technical, administrative, or factual errors.
FamilySafe will not use this provision to retroactively increase the price of a completed purchase or eliminate a material contractual right already earned under that purchase except when required by law or agreed by the affected customer.
21. Weather, Emergencies, and Events Outside FamilySafe's Control
FamilySafe may cancel, delay, relocate, reschedule, or modify services because of hurricanes, tropical storms, evacuation orders, severe weather, power or internet outages, facility closures, instructor illness, public emergencies, government action, transportation disruption, third-party platform outages, or other circumstances reasonably outside FamilySafe's control.
When FamilySafe cannot deliver a purchased service because of such an event, FamilySafe will provide the remedy required by the applicable offering terms and Refund & Cancellation Policy.
Unless otherwise agreed or required by law, FamilySafe is not responsible for a participant's separate travel, lodging, lost wages, childcare, transportation, or other incidental expenses resulting from a schedule change.
22. Third-Party Websites and Technology
FamilySafe may use or link to third-party websites, payment platforms, video-conferencing systems, scheduling systems, government resources, credentialing systems, or other services.
FamilySafe does not control independent third-party services and is not responsible for their separate content, policies, availability, or acts.
Use of a third-party service may also be subject to that provider's terms.
This section does not excuse FamilySafe from providing a remedy otherwise required when FamilySafe fails to provide a purchased service.
23. Disclaimer of Warranties
FamilySafe will provide the services expressly described for the applicable offering.
Except for express commitments made in the applicable offering, checkout, accepted proposal, or written agreement, and to the fullest extent permitted by law, FamilySafe disclaims implied warranties or representations concerning uninterrupted availability, particular outcomes, fitness for an unstated purpose, or results controlled by third parties.
FamilySafe does not warrant that a website, platform, or third-party service will operate without every interruption or technical error.
Nothing in these Terms excludes a warranty or consumer right that applicable law does not permit FamilySafe to exclude.
24. Limitation of Liability
To the fullest extent permitted by applicable law, FamilySafe Florida, LLC and its members, managers, employees, instructors, contractors, and agents will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from or relating to a FamilySafe service, including lost income, lost employment opportunities, lost business opportunities, or failure to obtain a desired examination, certification, licensing, employment, or business outcome.
Except for liability that applicable law does not permit to be limited, FamilySafe's aggregate liability arising from a particular purchased offering will not exceed the amount actually paid to FamilySafe for the offering giving rise to the claim.
Nothing in these Terms limits liability for conduct that cannot lawfully be disclaimed or limited.
Nothing in this section is intended to operate as a hidden pre-injury release for physical participation when a separate waiver is required by law or by FamilySafe.
25. Privacy
Collection and use of personal information are governed by the FamilySafe Privacy Policy.
Employer-sponsored and group participants should understand that FamilySafe may provide the purchasing organization with training-related information reasonably necessary to administer the sponsored service, as described in the Privacy Policy and any applicable agreement.
26. Electronic Transactions and Records
You consent to transact electronically with FamilySafe.
Electronic acceptance, electronic records, account activity, checkout records, submitted forms, and other electronic actions may be used to document a transaction or agreement to the extent permitted by law.
You are responsible for providing a current email address and maintaining the ability to receive electronic communications concerning your account or purchases.
You may retain a copy of these Terms and other transaction documents for your records.
27. Order of Precedence
If documents governing a transaction conflict, the following order controls only to the extent of the conflict:
a separately executed written agreement between FamilySafe and the customer;
an accepted proposal or quote containing transaction-specific terms;
offering-specific or checkout terms accepted for the transaction;
the Refund & Cancellation Policy applicable to the transaction; and
these Terms.
A document controls only matters it actually addresses.
28. Governing Law and Venue
These Terms and transactions with FamilySafe are governed by the laws of the State of Florida, without regard to conflict-of-laws principles, except to the extent federal law or another nonwaivable law applies.
Except where applicable law requires otherwise, any judicial action arising from these Terms or a FamilySafe transaction shall be brought in a court of competent jurisdiction located in Alachua County, Florida, or in the applicable federal court having jurisdiction over Alachua County.
The parties consent to personal jurisdiction in those courts for disputes properly subject to this provision.
Nothing in this section eliminates a consumer right or venue protection that cannot lawfully be waived.
29. Severability
If a provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, when appropriate, severed without invalidating the remaining provisions.
30. No Waiver
Failure by FamilySafe to enforce a provision on one occasion does not waive FamilySafe's right to enforce that provision or another provision later.
A waiver is effective only for the specific matter for which it is given.
31. Assignment
You may not transfer an individual account, enrollment, or rights under these Terms without FamilySafe's written consent.
FamilySafe may assign these Terms in connection with a merger, reorganization, sale of substantially all relevant assets, or other lawful transfer of the business or service, subject to applicable law.
32. Entire Agreement
These Terms, together with documents incorporated into them and any transaction-specific documents identified in Section 27, constitute the agreement between FamilySafe and the customer concerning the applicable service.
Statements in advertising, social media, informal communications, or general informational materials do not modify an accepted transaction unless incorporated into the agreement or otherwise legally binding.
33. Changes to These Terms
FamilySafe may revise these Terms prospectively.
The revised version will identify its effective or last-updated date.
Material contractual terms applicable to a completed purchase remain governed by the version presented or accepted for that transaction when FamilySafe's records establish that acceptance, except where a change is required by law or subsequently agreed by the parties.
Continued use of an ongoing service after notice of prospective revised Terms may constitute acceptance when permitted by law and when the circumstances reasonably provide notice and an opportunity to review the change.
